Kansas City partner Steve Coronado and senior counsel Daniel Young obtained summary judgment and dismissal of a defamation claim filed against a local city and two of its former council members. A developer and his company claimed the two former council members had slandered him in public comments suggesting his dealings with the city were under FBI investigation. The city was granted summary judgment on sovereign immunity grounds. The former council members established the truth of their statements, and the truth was absolutely fatal to the claims of the developer and his company. Under examination by Steve Coronado, the developer admitted he and several named associates were in fact the subject of a federal investigation. A partial transcript of these admissions was filed publicly, over the developer’s strident objections and were reported extensively by The Kansas City Star. A local attorney named in the investigation has recently been indicted on related federal charges.
